With that being said, here's how the changes will impact your community.</p><h3 id="what-are-the-changes-to-the-legislation-and-what-do-they-mean-for-condominiums-and-hoa-elections-in-maryland">What are the changes to the legislation, and what do they mean for Condominiums and HOA elections in Maryland?</h3><p>Starting October 1st, 2025, Community Associations governed by the Condominium Act or the HOA Act will now be required to have their elections conducted by "Independent Parties". The Independent Party can not be a candidate in the election or have a conflict of interest regarding any candidate(s) taking part in the election. Most importantly, the property managers of many associations will <em><strong><u>not</u> </strong></em>qualify as independent parties under these requirements.</p><p>This means that moving forward Community Associations will need a qualifying Independent Party, such as a third-party vendor, property management owned by the Association, or a commercial technology platform (i.e. GetQuorum), to conduct their election. Unit or lot owners can also qualify as an independent party, as long as they comply with the remaining requirements of Title 11 and Title 11b, do not campaign or electioneer for any candidate(s), and are not subject to the objection of more than twenty-five percent (25%) of the unit or lot owners who are eligible to vote.</p><h3 id="what-are-the-changes-to-the-legislation-regarding-the-review-of-association-records">What are the changes to the legislation regarding the review of Association records?</h3><p>In addition to the changes regarding elections, Maryland Senate Bill 758/ House Bill 1534 will also amend the Condominium Act and the Homeowners Association Act to prohibit Associations from charging owners for examining the financial statements or the meeting minutes of the Association in person, or for requesting and receiving them electronically. With that said, many Community Association Managers and boards have now begun to ask, What do these changes mean for my community? Let's take a look at how these changes may impact your community regarding governance meetings and elections.</p><p><strong>Virtual Meetings - </strong>The term "video conference" was added to s. 718.103 F.S., clarifying that board meetings and membership meetings can be conducted by video conference (such as Zoom or GetQuorum), provided that a hyperlink and call-in conference telephone number are included in the meeting notice, along with a physical location for unit owners to attend in person. Meetings held virtually will need to be recorded and maintained in the association's official records for a minimum of one year.</p><p>The amendments also clarify that unit owners may vote electronically if a unit owner membership meeting is held electronically and the foregoing requirements are followed.</p><p><strong>Electronic Voting - </strong>If 25 percent of the unit owners petition the board to adopt electronic voting within 180 days of the last annual meeting, community association boards must now hold a meeting to adopt electronic voting within 21 days after receipt of the petition.</p><p>If electronic voting is not provided to unit owners, the association is now required to provide unit owners the opportunity to transmit a ballot electronically (that complies with the statutory form) to an email address designated by the association. However, unit owners will need to waive anonymity if the vote is for the election as a result.  </p><p><strong>Annual Membership Meetings - </strong>If an annual membership meeting of the members is held electronically, a quorum of the board of directors must be present at the physical location of the meeting. </p><p>Unit ownership meetings will also need to be held within 15 miles of the association's property or within the same county as the association unless otherwise stated in its bylaws.</p><p><strong>Meetings Notices - </strong>The 14-day requirement for board meeting notices has been removed for meetings where electronic voting will be considered.</p><p><strong>Record Keeping -</strong> Official records now include electronic records, bank statements and ledgers, recordings of all such meetings that are conducted by video conference, and all affidavits as may be required by Chapter 718 F.S.</p><h3 id="what-does-this-mean-for-getquorum-customers">What does this mean for GetQuorum customers?</h3><p>While the passing of Bill 913 reemphasizes that GetQuorum's virtual meeting and electronic voting solutions continue to be a permissible and viable option to our loyal and growing client base across Florida, it also means that community associations governed under Chapter 718 F.S. will need to be prepared to embrace technology in their meeting and election processes, especially in the event unit owner's petition to adopt electronic voting. </p><p>While the ability to transmit a ballot electronically via email may be adequate for some communities, based on our experience, high adoption rate of electronic voting amongst owners when made available, the emphasis on voter anonymity amongst unit owners and the complexity of elections make adopting a user-friendly electronic voting platform that can accommodate the unique voting requirements of your community while upholding the secrecy of ballots a far superior method and borderline requirement to ensure efficient, effective community governance. Founded in 2005, Alliant has become a trusted partner to associations throughout Southwest Florida, focusing not only on being a management company but also on being a dedicated partner in building strong, well-managed communities through tailored, customized solutions and collaboration. However, while this commitment to innovation and finding creative ways to enhance operations has positively impacted the communities they service in various ways, it became evidently clear that Annual Meetings and Elections were still a pain point for many of Alliant's communities. Many regularly experience low participation among owners and consistently struggle to achieve a quorum, often resulting in reconvened meetings or, in some cases, Annual Meetings not being held altogether. </p><h3 id="stepping-away-from-paper-chaos-and-stone-age-solutions">Stepping Away From Paper Chaos and Stone Age Solutions</h3><p>In previous years, Annual Meetings and Elections had traditionally been held in person and heavily paper-based and required the Alliant team to conduct time-consuming, manual tasks such as individually reviewing and marking each ballot and supervising residents while they tabulated ballots - very inefficient processes that often resulted in having to redo ballot counts due to human error.</p><p>For those few Associations that opted into electronic voting, it was still a significant undertaking for Alliant. The process required substantial upfront work for their IT team, who weren't familiar with applicable statutes and voting requirements, adding another layer of complexity and potential risk that could jeopardize the compliance and integrity of the election results.</p><p>Aware of the shortcomings of these processes and the potential negative impact that consistently struggling to achieve quorum could have on how these communities operate, Erika knew they needed a solution that would make participation easier and more accessible for owners while reducing the administrative burden on their team.
