In response to the COVID-19 pandemic, the Government of Ontario passed the COVID-19 Response and Reforms to Modernize Ontario Act, 2020, which made temporary legislative amendments to the Condominium Act, 1998 (Condo Act) related to virtual meetings and the deferral of annual meetings in some circumstances. Previously set to expire on May 31, 2021, these temporary legislative provisions have now been further extended until December 31, 2021.

What Does This Mean for You?

For corporations governed under the Condo Act, the extension of these temporary legislative provisions permits corporations to call and hold virtual owner meetings, as applicable, notwithstanding certain restrictions or requirements until December 31, 2021.

Looking Ahead

The Ministry of Government and Consumer Services will continue to monitor COVID-19-related developments and analyze the feedback received from their recent consultation on the Regulatory Registry on whether further temporary or permanent amendments are needed under the Condo Act in relation to virtual processes. The ministry will communicate any future updates, as applicable.
